ATOMIC ENERGY AND RADIOACTIVE SUBSTANCES

The Atomic Energy (Americium) Order 2002

  Made 9th October 2002 
  Laid before Parliament 9th October 2002 
  Coming into force 1st December 2002 

Whereas the Secretary of State for Trade and Industry is of the opinion that the element americium may be used for the production or use of atomic energy or research into matters connected therewith.

     Now, therefore, the Secretary of State for Trade and Industry, in exercise of the powers conferred by section 18(1) of the Atomic Energy Act 1946[1], and now vested in her[2], hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Atomic Energy (Americium) Order 2002 and shall come into force on 1st December 2002.

Prescription of americium
    
2. Americium is hereby prescribed for the purposes of the Atomic Energy Act 1946.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order specifies Americium as a "prescribed substance" for the purposes of the Atomic Energy Act 1946. This confers upon the Secretary of State for Trade and Industry the power to: obtain information, enter and inspect, undertake work to discover minerals from which prescribed substances may be obtained, acquire prescribed substances and control the production and use of atomic energy through licensing.

Uranium, thorium, plutonium and neptunium or any of their respective compounds are already prescribed substances under the Atomic Energy Act 1946.
