The Minister of Agriculture, Fisheries and Food being designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred upon her by the said section 2(2), hereby makes the following Regulations: Title, extent and commencement 1. These Regulations extend to England only, may be cited as the Welfare of Animals (Slaughter or Killing) (Amendment) (England) Regulations 2001 and shall come into force on 31st December 2001. Amendment of the Welfare of Animals (Slaughter or Killing) Regulations 1995 2. Schedule 7, Part III, to the Welfare of Animals (Slaughter or Killing) Regulations 1995[3], shall be amended as follows -
(b) any mixture of argon, nitrogen, or other inert gases with atmospheric air and carbon dioxide provided that the carbon dioxide concentration does not exceed 30% by volume and the oxygen concentration does not exceed 2% by volume.";
(b) in paragraph 8(c)(iii)(bb) (which provides for a warning signal if the concentration of carbon dioxide rises above or falls below certain levels) for the words "falls below 25% or rises above 30%" there shall be substituted the words "rises above 30%"; and
(This note is not part of the Regulations) 1. These Regulations amend the Welfare of Animals (Slaughter or Killing) Regulations 1995 (the 1995 Regulations). 2. They substitute a new paragraph 7(2) of Part III of Schedule 7 to the 1995 Regulations, so as to permit a new gas mixture for killing birds at a slaughterhouse. They also make consequential amendments to paragraphs 8 and 10 of that Schedule. 3. A regulatory impact assessment has not been made.
