DEVOLUTION, WALES

The Government of Wales Act 1998 (Commencement No. 5) Order 1999

  Made 19th April 1999 

The Secretary of State for Wales, in exercise of the powers conferred upon him by section 158 of the Government of Wales Act 1998[1], hereby makes the following Order:

     1. This Order may be cited as the Government of Wales Act 1998 (Commencement No. 5) Order 1999.

    
2. In this Order, references to "the Act" are to the Government of Wales Act 1998.

    
3. The date of 1st May 1999 is appointed for the coming into force of the following provisions of the Act-

Schedule 6 paragraphs 1 and 2 and section 104(6) so far as relating thereto (Her Majesty's Chief Inspector of Schools in Wales - Status of Office).

Schedule 9 paragraph 17(9) and section 111(2) so far as relating thereto (Welsh Administration Ombudsman - "relevant tribunal").

    
4. The date of 1st July 1999 is appointed for the coming into force of the following provisions of the Act-

Section 104 and Schedule 6, so far as not already brought into force by article 3 of this Order (Her Majesty's Chief Inspector of Schools in Wales).

Schedule 9 paragraphs 14 to 16, 17(1) to (8) and (10), 18 to 27, and section 111(2) so far as relating thereto (Welsh Administration Ombudsman - Investigation of Complaints).

Schedule 10 paragraphs 2, 3(3) and (4), 5, 8 to 12, 15(3), 16, 17, and section 112 so far as relating thereto (Amendments of Health Service Commissioners Act 1993).

Schedule 12 paragraphs 5, 6, 8, 9, 15(3) , 17, and section 125 so far as relating thereto (Minor and Consequential Amendments).

Schedule 18 Part 1 (Repeals) in respect of the repeals in the Parliamentary Commissioner Act 1967[
2], the Local Government Act 1974[3], the Environmental Protection Act 1990[4], the Welsh Language Act 1993[5], the Health Service Commissioners Act 1993 section 2(5) and Schedule 1,[6] the Parliamentary Commissioner Order 1995 [7] and the School Inspections Act 1996[8], and section 152 so far as relating thereto.

This Order brings into force on 1st May and 1st July 1999 respectively, the following provisions of the Government of Wales Act 1998-

1st May 1999
Schedule 6 paragraphs 1 and 2, and section 104(6) so far as relating thereto.

Schedule 9 paragraph 17(9), and section 111(2) so far as relating thereto.

1st July 1999
All remaining provisions of section 104 and Schedule 6.

All remaining paragraphs of Schedules 9, 10 and 12 and sections 111(2), 112 and 125 so far as relating thereto.

All remaining repeals in Part 1 of Schedule 18 and section 152 so far as relating thereto.
