HIGHWAYS, ENGLAND AND WALES

The Street Works (Reinstatement) (Amendment) Regulations 1992

Coming into force 1st January 1993

    The Secretary of State for Transport and the Secretary of State for Wales in exercise of their powers under section 70(4), 71, 104(1) and 104(3) of the New Roads and Street Works Act 1991[1], and all other enabling powers, hereby make the following Regulations:—
        1.    These Regulations may be cited as the Street Works (Reinstatement) (Amendment) Regulations 1992 and shall come into force on 1st January 1993.
        2.    Regulation 2 of the Street works (Reinstatement) Regulation 1992[2] shall be amended as follows—
       (a) for paragraph (c) there shall be substituted the following paragraph—
          "(c) 'the Code' means the Code of Practice entitled "Specification for the Reinstatement of Openings in Highways"dated June 1992, and approved by the Secretary of State on 30th June 1992 as revised or reissued for time to time" ;
       (b) the words "per annum"occurring at the end of paragraph (c) shall be deleted;
       (c) after paragraph (e) the following paragraph shall be added—
          "(f) 'standard axle' means an axle which exerts a force of 80 Kilo Newtons."

EXPLANATORY NOTE

(This Note is not part of the Regulations)
    These Regulations correct defects in the definitions of "the Code"and "a road carrying more than 30 million standard axles"in the Street Works (Reinstatement) Regulations 1992 (S.I. 1992/1689) and add a definition of "standard axles".
    The Code of Practice entitled "Specification for the Reinstatement of Openings in Highways"is published by HMSO and may be obtained from their bookshops or by mail, fax or telephone from their Publications Centre, PO Box 276, London SW8 5DT (Telephone 071—873 8090, Fax 071—873 8200).
