TOWN AND COUNTRY PLANNING, ENGLAND AND WALES

The Planning and Compensation Act 1991 (Commencement No. 10 and Transitional Provision) Order 1992

Made 23rd June 1992

    The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by section 84(2) and (3) of the Planning and Compensation Act 1991[1] and all other powers enabling them in that behalf, hereby make the following Order:
    Citation
        1.    This Order may be cited as the Planning and Compensation Act 1991 (Commencement No. 10 and Transitional Provision) Order 1992.
    Provisions coming into force on 17th July 1992
        2.    The following provisions of the Planning and Compensation Act 1991 shall come into force on 17th July 1992—
      section 16, so far as it is not yet in force;
      section 20, so far as it is not yet in force;
      section 32, so far as it relates to the provisions of Schedule 7 set out in the first column of Schedule 1 to this Order, and, where there is an entry against that provision in the second column of that Schedule, to the extent therein provided; and
      section 84(6), so far as it gives effect to the repeals in Part I of Schedule 19 specified in Schedule 2 to this Order.

    Transitional provision
        3.    Section 20 of the Planning and Compensation Act 1991 shall not have effect in relation to any development where a resolution under regulation 4(1) or 5(2) of the Town and Country Planning General Regulations 1976[2], as the case may be, has been passed before 17th July 1992.
